Routes to enjoy in future?

 

Here are some routes which may soon find their way onto the Suffolk Definitive Map because evidence has been produced or discovered which suggests that they are historic rights of way – see `What if it's not on the Definitive Map?'.

 

In these cases the evidence has been considered by the County Council and found to be good enough to convince both officers and the Rights of Way Committee that a `modification order' should be made and advertised.  If there are no objections to the order by the end of the time ( 6 weeks ) permitted, the County Council will `confirm' the order – which means that the process is complete; the route in question has been proved to be a public right of way and will be added to the  Definitive Map.

 

If the Council decides that the evidence is not sufficient to justify the making of an order, the applicant has a right of appeal to the Secretary of State, one of whose officers will consider representations made by both sides and can then overrule the Council and direct the authority to make an order. This happens quite frequently and the success rate for RA appeals over the past 5 years is approximately 85%.

 

If there are objections to the order, the decision - whether or not to confirm it - will be taken by an independent inspector, usually after a public inquiry has been held at which the evidence is examined and arguments heard.

 

Modification orders have been - or soon will be - published for the following routes and, if  yet known, the public inquiry date is given alongside the map provided. Where the order is made at the direction of the Secretary of State as a result of a successful appeal, that is also indicated.
